The Litigation Practice Group at Lynn, Jackson, Shultz & Lebrun continues on a long tradition of excellence in litigation. The group’s lawyers have the breadth and depth of experience that ensures our clients we have the level of skill and expertise necessary to achieve winning results while conducting litigation activities in a courteous and professional manner. Our litigation practice includes representation of clients in jury and bench trials, arbitrations, mediations, and administrative proceedings. Several of our attorneys are fellows of the American College of Trial Lawyers, Best Lawyers in America, and Super Lawyers.

We represent regional, national, and international clients, as well as many clients across South Dakota. Our litigation lawyers have extensive trial experience and can draw upon broad subject matter experience throughout the firm.

Appellate Litigation

Our lawyers have a vast amount of experience in representing clients in appeals to Circuit Courts, the South Dakota Supreme Court, the Eighth Circuit Court of Appeals, and numerous other courts throughout the region.

Commercial Litigation

The lawyers of Lynn, Jackson, Shultz & Lebrun handle cases involving commercial law, contract disputes, construction issues, including claims of construction defect, restrictive covenants (non-compete and non-solicitation agreements), corporations, partnerships, unfair competition, intellectual property, banking, debtor/creditor and anti-trust.

Construction Litigation

We assist builders, architects and landowners with an array of issues that arise during and after construction of residential and commercial buildings.  

Employment Related Litigation

At Lynn, Jackson, Shultz & Lebrun, our litigation group works closely with Labor and Employment Practice Group to represent employers and employees in all aspects and phases of employment-related claims, including discrimination, sexual harassment, Title VII, and wage and hour claims.

Insurance Litigation

The attorneys at Lynn, Jackson, Shultz & Lebrun have a long history of assisting insurance companies by providing coverage opinions or other representation. The firms attorneys also represent insurance companies’ insureds in a variety of lawsuits, such as automobile accidents, personal injury and professional liability claims.  

Personal Injury Litigation

Lynn, Jackson, Shultz & Lebrun has successfully represented many individuals in a wide variety of personal injury claims, participating in mediation and jury and bench trials on behalf of its clients.

Product Liability Litigation

The Litigation Practice Group at Lynn Jackson represents retailers and manufacturers in product liability claims, as well as those injured as a result of defective products.

Professional Liability Litigation

We represent hospitals, clinics, physicians and other medical providers in medical malpractice actions. We also assist veterinarians, dentists, attorneys, accountants, architects and other professionals in negligence actions brought against them.

Trusts and Probate Litigation

Lynn Jackson's Litigation Practice Group, along with our trusts and estate lawyers, possess a great deal of knowledge and experience to assist clients with trust and probate disputes.

Juvenile Court

Lynn Jackson attorneys have experience handling a variety of cases relating to juvenile law.  We represent juveniles who have been charged with delinquency offenses (crimes committed by a child), abuse and neglect cases (cases in which a child’s safety is threatened through acts or omissions of a parent, guardian, or custodian) and CHINS or status offenses (cases involving unexcused absences from school, running away from home, child in need of supervision and/or beyond parental control, and the underage purchase or consumption of alcohol or tobacco).
