Our History

Horace Jackson

Lynn, Jackson, Shultz & Lebrun, P.C., has a proud history of providing top quality legal services to South Dakota and our region, and has done so for more than 72 years. 

The Firm was founded in Rapid City, South Dakota, by Charles Whiting and John Wilson under the name of Whiting and Wilson. Whiting was the son of a South Dakota Supreme Court Justice, Charles Whiting, and Wilson was counsel to South Dakota and its state-owned cement plant. Wilson developed an expertise in the cement plant business and moved to the eastern seaboard to advise cement companies. After World War II, Kelton S. Lynn returned to Rapid City and joined with Whiting and Wilson. The Firm was known as Whiting, Wilson and Lynn. Both Whiting and Lynn distinguished themselves in their World War II service to our country. Whiting served in the JAG office and in the prosecution at the Nuremberg trials. Lynn returned as a combat veteran and a decorated war hero.

After peace was declared in 1945, the Firm grew and became one of West River’s premier law firms. Horace Jackson left the U.S. Attorney’s Office of Civil Litigation in 1961 and joined the Firm. He established a reputation for trial and appellate excellence in condemnation cases, where land was acquired for the construction of Lake Francis Case and the dam at Chamberlain, South Dakota.

Donald R. Shultz

Donald R. Shultz

Donald R. Shultz, a Huron Native, joined the firm in 1956. Don served as President of the South Dakota State Bar Association, as well as National President of the American Board of Trial Advocates. Don’s steadfastness, friendliness, courtesy, and perseverance have been character traits he instilled in all members of the Firm. Gene N. Lebrun joined the firm in 1964 as a graduate of the North Dakota School of Law, and he served as Speaker of the South Dakota House of Representatives, President of National Conference of Commissioners on Uniform State Laws, and Chairman of the Board of the South Dakota School of Mines & Technology. Gene’s love of public service has gained him prominence in local, state, and national organizations.

Under Gene’s direction, the Firm distinguished itself in major litigation such as the construction of the Minuteman Missiles in western South Dakota and the representation of the City of Rapid City following the disastrous flood of 1972, which led to the condemnation proceedings wherein the City of Rapid City acquired more parkway along the beautiful Rapid Creek than the City of Denver, Colorado, could ever acquire.

Gene N. Lebrun

The Firm opened an office in Sioux Falls, South Dakota, in 1987 as a result of statewide clientele and major litigation in federal and state courts throughout the state. In 2016 Lynn, Jackson, Shultz and Lebrun, P.C., established an office in Spearfish, South Dakota. Currently the firm has a total of 26 lawyers actively providing legal services to its clients in the entire region, including Wyoming, North Dakota, Minnesota and Iowa. The Firm’s lawyers are admitted in South Dakota state courts, as well as the Federal District Courts, the Federal Court of Appeals, and the United States Supreme Court.
